Website Maintenance Terms of Service: “Buy My Brain”

By booking Buy My Brain, you agree to the following terms and conditions. These terms are designed to ensure the smooth delivery of the service and clarity for all parties.

1. Service Overview

The “Buy My Brain” service provides website maintenance for WordPress websites through pre-purchased time blocks. Clients can choose between:

  • 5 hours: £300
  • 10 hours: £550

Included Services:

  • Updating copy provided by the client.
  • Uploading images, blogs, or other content provided by the client.
  • Adding new pages using the existing design layout.
  • Improving website layout in specific areas (without a full redesign).
  • Troubleshooting technical issues within WordPress (hosting issues covered only if hosted with us).
  • Adding or updating plugins.

Excluded Services:

  • Copywriting.
  • Full website redesigns.
  • Strategic SEO work.
  • Paid plugins or licences.
  • 1:1 consultations (online or onsite).
  • Website hosting.
  • Photography or sourcing stock images.
  • Website training.

This is a done-for-you service, and no training or instructional guidance will be provided as part of this agreement.

2. Customer Obligations

To ensure the smooth delivery of services, the Customer agrees to:

2.1. Submit requests via email only to katrina@cariadcreative.com. Requests sent via social media, WhatsApp, text messages, or phone calls will not be accepted.

2.2. Provide clear and complete instructions for all requests.

2.3. Submit any required materials in an acceptable format:

  • Text: Word Documents, Google Docs, or written in the body of the email.
  • Images: All images must be sent as .jpeg or .png files via email or through WeTransfer.
  • Videos: Videos must be “website-ready” in .mp4 format and sent via WeTransfer

2.4. Provide login details for website access. It is recommended that the Customer creates a unique login for the Supplier to ensure security. However, the choice of login details is at the Customer’s discretion.

3. Additional Requests

3.1. Any work outside the scope of the maintenance package will be quoted and charged separately, with the Customer’s prior permission.

3.2. If the Customer is unsure whether their request is covered under the maintenance package, they are encouraged to email the Supplier to confirm before submitting the request.

4. Validity of Hours

4.1. Purchased time blocks are valid for 12 months from the date of purchase. Unused hours will not be carried over beyond this period.

4.2. The Customer will be notified when only 1 hour remains in their block.

5. Response Times

5.1. Requests submitted Monday-Friday will typically be responded to and actioned within 24 hours, though some may take up to 48 hours.

5.2. Requests received on Fridays may be prioritised the following Monday if not completed that day.

5.3. Requests submitted on bank holidays will be addressed on the next working day.

5.4. While urgent requests will be accommodated when possible, they are not guaranteed.

6. Delays and Approval

6.1. If the Customer fails to respond to queries, provide materials, or approve work within 3 working days of being notified, the Supplier reserves the right to pause work. Any amendments requested after this period will be deducted from the Customer’s time block.

6.2. Timely approval of work ensures smooth project progress.

7. Payment and Pricing

7.1. Full payment is required upfront for all time blocks.

7.2. Time is counted in increments of 15 minutes, rounded up to the nearest increment.

7.3. Additional work beyond the purchased time block will require a new time block purchase.

7.4. Late Payments: If payment is not received on time, all support will be suspended until payment is made in full.

7.5. Refund Policy: Payments are non-refundable. However, in the case of significant issues, the Customer may discuss these with the Supplier for resolution.

8. Performance Standards and Disclaimer

8.1. The Supplier will provide services with reasonable care and skill, in accordance with the Supply of Goods and Services Act 1982.

8.2. The Supplier does not guarantee that website maintenance will improve SEO, website traffic, or conversions.

8.3. The Supplier is not responsible for any issues or changes made by the Customer, third parties, or other individuals with access to the website.

9. Confidentiality

9.1. Both parties agree to keep all sensitive information shared during the course of this agreement confidential.

9.2. The Supplier will not disclose the Customer’s confidential information to any third party without prior written consent, except where required by law.

10. Portfolio Use

10.1. The Supplier reserves the right to showcase completed work in their portfolio, marketing materials, and social media.
10.2. If the Customer requests that specific work remains confidential, the Supplier will honour this request.

11. Termination and Rescheduling

11.1. Either party may terminate this Agreement with 14 days’ written notice.

11.2. Unused hours are non-refundable but may be transferred to another time block at the Supplier’s discretion.

12. Limitation of Liability

12.1. The Supplier is not liable for:

  • Loss of revenue or profit.
  • Third-party software or plugin issues.
  • Hosting provider failures (unless hosted with Cariad Creative).
    12.2. Total liability is capped at the value of the contract (£300 for 5 hours or £550 for 10 hours).

13. Force Majeure

Neither party will be held liable for delays or non-performance caused by events outside their reasonable control, including but not limited to natural disasters, internet outages, or government restrictions.

14. Data Protection

The Supplier will process personal data in compliance with the UK GDPR and the Data Protection Act 2018.

15. Governing Law and Dispute Resolution

This Agreement is governed by the laws of England and Wales. Any disputes will be resolved through negotiation, mediation, or Small Claims Court if necessary.

16. Acceptance

By purchasing a “Buy My Brain” time block, the Customer agrees to the terms outlined in this Agreement.
